TERMS AND CONDITIONS OF SALE
These Terms and Conditions govern the sale and purchase of NFTs provided by OYA Studio LLC, located at 30N Gould St., St. R, Sheridan, Wyoming (“we”, “us”, or “OYA Studio”). By purchasing NFTs from store.oyabun.io (“Website”), you (“the User”) explicitly agree to these terms.
Product Details
- NFT Boosters may either be sold directly as NFTs or revealed upon minting. Boosters themselves cannot be owned or stored independently in a wallet.
- All NFTs are minted exclusively on the Polygon blockchain. Users may incur additional blockchain transaction fees (“gas fees”) during the minting process, which are directly charged by the Polygon network. OYA Studio has no control over and is not responsible for these fees.
- NFTs within boosters are selected randomly based on a probability grid. This grid may or may not be disclosed at the sole discretion of OYA Studio. Users accept the random nature of NFT distribution.
User Responsibility and Risks
- OYA Studio is not responsible for any loss or damage resulting from user actions or errors, including, but not limited to, incorrect wallet addresses, misunderstanding blockchain functionality, or loss of access to private keys.
- The User acknowledges the inherent risks associated with blockchain technology, including volatility, technological errors, cybersecurity risks, hacking, and other forms of cybercrime.
- Users explicitly accept full responsibility for securing their digital wallets, including the safe storage and management of private keys and passwords.
Intellectual Property Rights
- Ownership of an NFT does not grant any copyright, trademark, or intellectual property rights to the underlying content, artwork, or designs associated with the NFTs. All intellectual property rights remain solely with OYA Studio.
Limitation of Liability
- Under no circumstances shall OYA Studio, its affiliates, employees, or directors be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from the use or inability to use the NFTs or the Website.
- Our total aggregate liability for any claims or disputes relating to transactions shall never exceed the amount actually paid by the User to OYA Studio.
Refund and Cancellation Policy
- Due to the digital and irreversible nature of blockchain transactions, all sales are final. Refunds, returns, exchanges, or cancellations are strictly prohibited after a transaction is complete.
Modification of Terms
- OYA Studio reserves the right to modify these Terms at any time, without prior notice. Continued use of our services following any changes constitutes acceptance of the new Terms.
Dispute Resolution
- Any disputes arising from these Terms shall be governed exclusively by the laws of Wyoming, USA. The User consents to jurisdiction and venue in Sheridan County, Wyoming.
